Negotiating the final account

Two experienced surveyors can usually predict the settlement within a few per cent on day one. The months in between are spent proving what both already suspected.

By the time a final account reaches negotiation, most of it is settled. Measured work is measured, the majority of variations are agreed, and the argument is about a handful of items that carry most of the difference.

Separate the account from the argument

The first useful step is to agree what is agreed. Sign off every line that is not in dispute, and reduce the document to the items that actually separate the parties.

On a hundred-line account that usually leaves eight or ten. Both sides can then see the size of the gap, which is often smaller than the correspondence suggests and occasionally much larger.

A negotiation over ninety lines never converges. A negotiation over nine does, because both sides can hold all of it in their head at once.

Know which items are principled and which are priced

Some disputes are about entitlement: was this a variation at all, was there an instruction, is this a relevant matter. Those do not split the difference sensibly, because one side is right.

Others are about quantum: both agree it is payable and disagree about how much. Those settle in the middle, and everybody knows it.

Mixing the two is what makes negotiations stall. An entitlement point conceded to buy movement on a quantum point sets a precedent that outlasts the job.

The order that works

  1. Agree the undisputed lines and take them off the table.
  2. Settle the quantum items, which are usually quick.
  3. Deal with the entitlement items last, on their merits.

Doing it in the reverse order, which is what happens by default, means the hardest items are argued while everything else is still open and available to be traded.

Record what was agreed and why

Not just the number. A note saying that item fourteen was settled at eleven thousand on the basis that the rate applied to the first two hundred metres only, so that when a similar item arises later nobody has to reconstruct the reasoning.

The relationship

Most final accounts are between people who will meet again. A settlement reached by grinding somebody down on a point they were right about is remembered, and it gets priced into the next tender.

That is not an argument for conceding. It is an argument for being right, being quick, and being clear about which of those two categories each item falls into.
